These Terms and Conditions along with this form have the characteristics of a one-time payment agreement within the scope of Law on Payment and Security Settlement Systems, Payment Services and Electronic Money Institutions numbered 6493 and the relevant regulations.

Beneficiary Declaration

Sending customer hereby declares that he will act as the real beneficiary as defined in ‘’Article no:15 of Law No 5549 on Prevention of Laundering Proceeds of Crime’’ published on the Official Gazette on October 18th, 2006. The customer further agrees and undertakes to comply with the Law No: 5549 and its provisions for declaring his authorization and providing necessary identity verification documents prior to the transactions done by himself on behalf of someone else.

I hereby acknowledge and declare that I will not hold Tronapay responsible for any direct or consequential damage or loss to occur due to non-delivery of the transfer amount to the recipient as a result or false incomplete information or missing or incomplete IBAN number. I also acknowledge and declare that Tronapay will not be held liable in case the sender or receiver information is listed in any sanction list published by the domestic or international authorities, in case there are precautionary measures being applied by authorized courts about the sender or receiver or in case the transfer amount is not processed or confiscated by the correspondent bank or recipient’s payment corporation or not paid to the recipient due to similar reasons. I agree and declare that Tronapay is not responsible for extra charges that come from correspondent bank because of SWIFT transaction and allow Tronapay to charge for dormant funds. I acknowledge and declare that I have read and understand the explanations on the form and that the form is filled correctly and completely and declare that the mobile phone number I have provided on the form shall be used in all legal communication with Tronapay. The “Payment Services Sector” is also deemed liable in accordance with the Law No. 5549 ON THE PREVENTION OF LAUNDERING OF CRIME REVENUES and the relevant article of the policy and regulation. The obliged parties, the prevention of money laundering and terrorist financing crimes’ Law No.5549 and the communiqués were brought.

According to the 15th article of the Law No. 5549 ON THE PREVENTION OF LAUNDERING OF THE INCOME OF CRIME; “In transactions requiring identification to be made before or through obliged parties, a person acting on his behalf but on behalf of someone else shall be sentenced to imprisonment from six months to one year or a judicial fine of up to five thousand days, unless he informs the obliged parties in writing before performing these transactions. ”

In this respect, the real person and / or legal persons who have made a transaction requiring identification within the framework of the Law No.5549, relevant regulations and communiqués before our Company, who act on their behalf but on behalf of someone else, declare in writing on whose behalf and account they act before performing these transactions. There is an obligation to do. In cases where it is not declared that a transaction was made on behalf of someone else, it is deemed by our Company that you are making transactions on your own behalf and account.
